In order to consider a substance or object as a by-product, these four conditions must be met simultaneously; that is, only if each and every one of them is met, we will be dealing with a by-product; otherwise, the applicable legal regime will necessarily be that of waste.

Article 5 of Law 22/2011, of July 28, on waste and contaminated soils, on the end of the condition of waste, grants the Ministry of Agriculture and Fisheries, Food and Environment (currently the Ministry for Ecological Transition and the Demographic Challenge) the power to establish by ministerial order, the specific criteria that certain types of waste that have been subjected to a recovery operation, must meet in order to cease to be considered as such.

No procedure has been foreseen for individuals to request the application of the end-of-waste concept, as is the case for by-products, but rather it is the Ministry that makes the decision on the waste streams for which it is most appropriate to evaluate the possible establishment of end-of-waste criteria. Currently, priority is being given to those waste streams that may have greater environmental relevance, considering the type of waste, the impact on broad sectors of economic operators and the quantities of waste affected.
